Three Tips for Protecting Your Rights in Accident Claims:
Tip #1 – No Contact with the other side (defense, defendant, insurance company). Do not discuss your case or anyone else’s case with an investigator, an employer, an insurance adjuster, a defense attorney or anyone else. Unless your attorney is present. Standing alone without an experienced and competent lawyer, you do not know the rules and you can be tricked into ruining your case!
Tip #2 – Danger-Defendants and Insurance Companies Videotaping you. Expect to be videotaped by the other side, especially if you are off work because of an injury. The more serious the case, the more the insurance company will do activity checks and surveillance of you! Do not carry groceries, lift children, wash cars, perform yard work, play sports, or participate in any other strenuous activity. You should not be doing anything your doctor has told you not to do. Many injured workers have had their cases ruined this way. Videotape can be very prejudicial and very damaging to your case. Videotape does not show the after affects of your activities and can be very misleading.
Tip #3 – Always Tell the Truth. Trials are battles for credibility about who to believe. Whoever the Judge or Jury thinks is telling the truth is who wins! Your credibility is your biggest asset in a case, do not ruin it! Always tell the truth, even if you think it will hurt your case. Do not try to slant the facts in your favor. The truth can be explained, no lie can be! The truth always works the best!
